TERMS OF USE & SALES POLICY

1. Agreement to Terms

By accessing this website or submitting any item(s) for review or sale, you (“User,” “Seller,” or “Submitter”) agree to be bound by these Terms of Use and all applicable laws and regulations.

2. Eligibility

You must be at least 18 years of age to use this website or sell items to New Time Toys. By submitting items, you represent that you are legally competent and the rightful owner of all property submitted.

3. Ownership & Legal Authority

By submitting items for review or sale, you affirm that:

• You are the lawful owner of the property
• The items are not stolen
• The items are free of liens or encumbrances
• You have full authority to sell the property

You agree to indemnify and hold harmless New Time Toys from any claims, disputes, or liabilities arising from fraud, misrepresentation, or ownership disputes.

4. Items Considered for Purchase

New Time Toys reviews and purchases video games, consoles, trading cards (including Pokémon), sealed products, graded cards, collectibles, and related accessories.

Submission of items does not guarantee purchase. We reserve the right to decline any submission at our discretion.

5. Review, Estimates & Inspection Policy

Submissions are reviewed based on photos and information provided.

Any discussion of pricing prior to inspection is preliminary and non-binding.

All pricing is confirmed only after in-person inspection and verification of:

• Condition
• Completeness
• Authenticity
• Functionality
• Regional compatibility (North American NTSC where applicable)

We reserve the right to adjust or decline a transaction if items materially differ from what was represented.

6. Condition & Functionality

Unless explicitly confirmed as tested and fully functional, pricing reflects unknown condition.

Items presented for sale should be in overall salvageable condition and free from excessive damage, counterfeit characteristics, or undisclosed alterations.

7. Meeting & Transaction Process

Inspections and transactions are conducted at mutually agreed-upon public meeting locations.

Submission of items does not obligate either party to complete a transaction.

8. Final Sale Policy

All completed purchases made by New Time Toys are final.

Once payment is made and the transaction is completed, ownership transfers to New Time Toys and the sale is non-refundable.

9. Payment Terms

Payment is issued at the time of completed inspection and agreement via cash or approved digital payment method.

New Time Toys is not responsible for market value fluctuations after purchase.

10. Limitation of Liability

To the fullest extent permitted by law, New Time Toys shall not be liable for any indirect, incidental, consequential, or punitive damages arising from website use or any transaction.

Maximum liability shall not exceed the amount paid to the Seller for the item(s).

11. Privacy & Information Use

Information submitted through this website is used solely for reviewing items, communicating regarding potential transactions, and arranging inspections.

We do not sell personal information. Information may be disclosed if required by law.

12. Right to Refuse Service

New Time Toys reserves the right to decline any transaction at its sole discretion.

13. Governing Law

These Terms shall be governed by the laws of the State of New York. Any disputes shall be resolved in the state or federal courts located in Nassau County, New York.

14. Trademark Notice

New Time Toys is an independent buyer of pre-owned video games, consoles, trading cards, and collectibles. We are not affiliated with, endorsed by, or sponsored by Nintendo, Sony, Microsoft, Sega, The Pokémon Company, or any other brand or manufacturer mentioned on this website. All trademarks and product names are the property of their respective owners.
